These Terms of Service ("Terms") govern your access to and use of the WishDrop website, mobile application, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS.

1. Description of Service

WishDrop is an AI-powered platform that allows users to create personalized birthday videos by animating user-uploaded images and characters using artificial intelligence technology. The Service provides the technological framework, animation, voice synthesis, and video rendering capabilities to transform static images provided by you into dynamic video greetings.

2. User Accounts

To access certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Notify us immediately if you discover or suspect any security breaches related to the Service or your account.

You are responsible for all activity that occurs under your account.

3. User Content and Copyright Policy

3.1. User Responsibility

You are solely responsible for the images, text, and other content you upload, submit, or otherwise make available to the Service ("User Content"). You represent and warrant that:

  • You own all proprietary rights in the User Content, or, with respect to any content you do not own, you have the full authority and right to upload said content and grant the licenses set forth herein.
  • Your use of the Service to animate or modify such content does not infringe the copyright, trademark, right of publicity, or other intellectual property or proprietary rights of any third party.

3.2. Our Role as a Tool Provider

WishDrop and Limitless Being LLC provide a neutral technology platform for content creation. We do not provide, sell, or license copyrighted characters, images, or media. Any examples of popular characters shown on our website or marketing materials are for demonstration purposes only to illustrate the capabilities of our AI technology. These examples may represent previous user orders or internal tests and we do not claim ownership of, nor do we distribute, these third-party intellectual property assets as templates or stock content. The Service is a neutral technology. Any likenesses generated are at the sole discretion and liability of the user.

3.3. License Grant

By uploading User Content, you grant Limitless Being LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content solely for the purpose of providing the Service to you (i.e., generating your requested video). We do not claim ownership of your User Content.

3.4. Prohibited Content

You agree not to upload any content that:

  • Is unlawful, infringing, or fraudulent.
  • Contains hate speech, explicit violence, or pornography.
  • Exploits or harms minors.
  • Infringes on the intellectual property rights of others without permission.

We reserve the right to refuse to process any order or remove any User Content that violates these Terms.

4. AI Generations and Disclaimers

4.1. AI Artifacts

The Service uses advanced artificial intelligence to generate videos. You acknowledge that AI technology is experimental and may produce unexpected results, including visual artifacts, distortions, or audio inconsistencies. While we strive for high quality, we do not guarantee that the generated video will be perfect or error-free.

4.2. Likeness and Voice

The Service may generate synthetic voices or animations. You agree not to use the Service to impersonate individuals, celebrities, or public figures in a deceptive, defamatory, or harmful manner.

5. Payments and Refunds

5.1. Pricing

Prices for the Service are displayed on the website and are subject to change without notice. You agree to pay all fees associated with your order.

5.2. Refund Policy

We offer a 30-Day Money Back Guarantee. If you are not satisfied with your video for any reason, you may request a full refund within 30 days of your purchase by contacting us at hello@limitlessbeing.xyz. We want to ensure you are happy with your magical moment.

6. Intellectual Property Rights (Our Content)

Except for your User Content, the Service and all materials therein, including software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, and music (the "WishDrop Content"), and all Intellectual Property Rights related thereto, are the exclusive property of Limitless Being LLC and its licensors.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIMITLESS BEING LLC, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.

UNDER NO CIRCUMSTANCES WILL LIMITLESS BEING LLC BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

OUR LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless Limitless Being LLC and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Service.
  • Your violation of any term of these Terms.
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
  • Any claim that your User Content caused damage to a third party.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
